PURCHASE TERMS & CONDITIONS

 I.      INTRODUCTION

This is a legal agreement between you (an individual or a single entity, also referred to in this agreement as "BUYER", "you") and ZettaCube Limited ("ZETTACUBE").

The purchase and delivery of the products on ZettaCube Limited's website ("WEBSITE") is governed by the Terms and Conditions ("TERMS") in this document.

By proceeding with the purchase procedures on the WEBSITE, you agree to be bound by the TERMS.  If you do not agree to any of the TERMS, please DO NOT proceed with the purchase procedures NOR making any payment.

II.      PRODUCT EULA

Please refer to the End-User License Agreement (EULA) of individual product for the terms and conditions of installing, purchasing or other using that product.

III.      PRODUCT PRICING

Price of individual product may change.  By completing the purchase procedures, you agree to pay for the product(s) at a price indicated at the purchase procedures.  However, ZETTACUBE reserves the rights to cancel an order if ZETTACUBE considers the price information is incorrect.

IV.      PAYMENT

PayPal (http://www.paypal.com/) is used as the payment processor.  No information, except those critical to the selling and delivery of the products, will be revealed by PayPal to ZETTACUBE.  ZETTACUBE does not process or store credit card information.

ZETTACUBE does not represent PayPal in any way.

V.      PRODUCT DELIVERY

Product delivery will commence after the payment at PayPal has been confirmed by ZETTACUBE.  Most of the products can be downloaded from the WEBSITE.  The license files will be sent to the BUYER through email.  BUYER should make sure a correct email address has been provided at the purchase procedures.

VI.      NO REFUND

Once you placed an order, and the license information is emailed to you, no refunds will be given.  So please evaluate and test the products carefully during the trial period.

VII.      ORDER CANCELLATION

ZETTACUBE reserves the right to cancel any outstanding order due to technical failure on the WEBSITE or PayPal's website, incorrect price or product information, insufficient customer information, or any other reasons that ZETTACUBE may consider unable or unsuitable to fulfill the order.

If ZETTACUBE cancels an order, BUYER will be refunded the amount actually received from PayPal by ZETTACUBE for that order.  Normally, the refund amount would be the product price less the applicable transaction fees.

VIII.      LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZETTACUBE BE LIABLE FOR ANY CLAIM, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROCESSES OF PURCHASE, PAYMENT, DELIVERY, OR ANY OTHER ACTIVITIES RELATED TO THE SELLING OF ZETTACUBE'S PRODUCTS, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION.

ZETTACUBE DOES NOT REPRESENT PAYPAL IN ANY WAY.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZETTACUBE BE LIABLE FOR ANY CLAIM, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PAYMENT PROCESS PROVIDED BY PAYPAL, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION.
